Please familiarize yourself with PropertyClubPro's Listing Policies and Guidelines (the Listing Policies) prior to entering a property listing on the PropertyClubPro website. All listings are subject to these Listing Policies & Guidelines and the Terms of Use.
Submission and Maintenance of Listings
The Customer agrees to allow the property listing, or any part of it, to be searched, displayed, accessed, downloaded, copied, and otherwise referred to by users of the PropertyClubPro website (the “Site”), and Company shall have the right to modify the property listing in the exercise of its rights under its Terms of Use or of this Listing Policy. The Customer will be solely responsible for retaining back-up copies of all information provided to the Site.
Customer agrees not to submit to the Site any information including but not limited to property descriptions, photographs, renderings, financial, contact or other information regarding a property unless Customer has received all necessary rights and authorizations to do so from all third parties. By entering listings on the PropertyClubPro Site, Customer represents and warrants that it owns or otherwise controls all of the rights to such content including, without limitation, all the rights necessary for Customer to provide, post, upload, input or submit such content, and that such action by Customer will not violate the intellectual property rights of any third party. The Company cannot police or control all of the content provided by Customer(s) that is made available on the PropertyClubPro Site.
All listings and other information entered on PropertyClubPro may be subject to review by Company personnel or their agents prior to becoming available for full viewing online. Even if such information is so reviewed, Customer remains solely responsible for abiding by these Listing Policies & Procedures and by the Company’s Terms of Use. If a listing or other information submitted by a Customer violates any of the Listing Policies & Guidelines stated herein, the Company may withhold posting until the issue(s) in question have been addressed. If the Company determines that a listing violates these Listing Policies & Guidelines or contains inaccurate or incomplete information, the Company will send an email message to the Customer about such listing noting that the proposed listing does not conform to established Listing Policies & Guidelines, and giving the Customer a reasonable period of time (usually three business days) to respond. It is then the sole responsibility of the Customer to revise the listing or information as appropriate, and resubmit the corrected listing or information.
Customer agrees that the Company and its affiliates shall have the right to use listings and other information submitted to it for any purpose, including without limitation for publication of all or part of such listing on the internet for unrestricted use by the Company and its customers and partners. The Company shall have sole authority to choose the manner in which any listing will be received, displayed and used, and reserves the right to remove all or any part of a listing or refuse access to anyone at any time in its sole discretion.
Listing Content
PropertyClubPro is a web site for commercial real estate. Listing of single-family residences is prohibited on the PropertyClubPro website.
Required Fields
All fields on the submission form found on the Add Property page of the Site that are noted with an asterisk (*) are required fields that must be completed with valid data pertaining to the property being listed. Do not enter terms designed to conceal the required information about the property being listed. The Company may, without notice, remove a property listing from the Site if data is missing, misleading, or invalid, and repeated violations of this policy may result in the Company’s removal of all of such Customers active listings on the Site.
Address Fields
Address fields are intended for listing the physical address or intersection of the property being listed. Do not enter additional information about the property.
Property Description
Property descriptions are for the description of the property that is for sale or for lease only. The posting of contact name, phone number, fax number, company information or URL links for any contacts including those who are not PropertyClubPro members is strictly prohibited in this section. Also, only PropertyClubPro registered premium users may have their contact information listed.
Property Photographs
Photographs posted, attached, or affixed to listings must be actual photographs of the property being listed. The Company may remove photographs that are not directly related to the building or property being listed, including brokerage company logos.
Property Type
Properties must be identified with the appropriate property type, and up to three property subtypes. Adding the same listings under multiple property types is prohibited.
Pricing
A valid sales price in the Price Asking field for the listed property is required for all PropertyClubPro sales listings and a valid rental rate for each space is required for all PropertyClubPro lease listings. Confidential pricing is permitted on sales listings for Premium members only via the Opinion of Value function. Opinion of Value, a check box listed next to the Price Asking field, displays the sales price for searchers on the PropertyClubPro site as Not Disclosed. By entering a valid Asking Price in the required field and utilizing this function, properties will return in price range searches; however, the actual price will remain confidential.
Contact Information
Premium Member Listings added to the PropertyClubPro web site will only receive Premium Listing benefits if all contacts referenced for that listing are also Premium Members. If a Basic Member is added as an additional contact to a Premium Member Listing, the listing will become a Basic Listing.
Confidential Listings
Only Premium Members may submit a Confidential Listing.
Duplicate Listings
Duplicate listings of a property on the Site (either by the same Customer or by multiple Customers) will be removed. Customers may, however, list a property for sale and for lease at the same time. A duplicate is defined as the same physical property listed under more than one property identification number. Office condos with the same physical address are not considered duplicates if a unique unit number is included in the address field. Land parcel listings are not considered duplicates if the aggregate area of all individual parcels listed does not exceed the total area available at the physical site. The same space may not be listed more than once on the Site at the same time. A space listing is defined as a single suite or unit of space listed for lease. PropertyClubPro provides minimum divisible/maximum contiguous options for divisible space and up to three (3) subcategories for space type under space detail. Total space available in a building cannot exceed the total square footage of the building. PropertyClubPro reserves the right to combine duplicate space listings into a single listing or to remove the listing from the system with or without contacting the listing broker.
Quantity and Access Limitations
Premium membership is not an unlimited listing membership. Pemium members must list all premium listings in accordance with PropertyClubPro's Terms of Use and these Listing Policy & Guidelines. PropertyClubPro reserves the right to remove, or demote to Basic listing status, listings that are deemed excessive in number. Basic listings submitted to PropertyClubPro will only be available to premium Members searching for property on PropertyClubPro and will not be fully displayed in search results for other basic members to view.
Other Prohibited Conduct
Customers are advised to refrain from engaging in the following conduct:
Posting listings on the Site of properties that have already been sold or are no longer on the market. All listings for properties already sold or off-market may be removed by the Company.
Improper use of keywords: Keywords identified in the property name, property description, location description or property highlights field that are clearly not relevant to the property being marketed may be removed by the Company.
Use of offensive language: Use of profanity or vulgar language in any section of the Site is strictly prohibited. This includes the use of language that is generally considered obscene, profane, sexual, hateful, or racist in nature.
The Company may, in its sole discretion but without any obligation to investigate further, remove or modify the information with respect properties that are alleged to have been submitted in violation of the provisions its Terms of Use or of this Listing Policy. The Company shall not be required to monitor or verify the accuracy or proper use of any information contained on the Site nor to resolve disputes among Customer and any third party.
In addition, the Company may require additional evidence of compliance with any provision of this Listing Policy or Terms of Use. The Company may also, in its sole and absolute discretion, terminate the accounts of, and refuse service to, any Customer who repeatedly or knowingly violates its Terms of Use or of this Listing Policy.
Violation of these provisions by a Customer may, at the sole discretion of the Company, lead to the removal of all of that Customer’s active listings from the Site and suspension of that Customer’s ability to list properties on the Site.
Copyright Complaints
If you believe that your work has been copied onto the PropertyClubPro website in a way that constitutes copyright infringement, please provide the following information to PropertyClubPro, C/O John Wubbel Consultancy, Inc. 5344 Lake Blvd., Delray Beach, FL 33484:
A description of the copyrighted work that you claim has been infringed upon;
A description of where the material that you claim is infringing is located on PropertyClubPro, with identifying information for the listing, if applicable;
Your address, telephone number, and e-mail address;
A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or under applicable law;
A signed statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
